Supreme Court today hearing pleas regarding CA July exams has ordered ICAI to roll out an “unconditional opt-out” option for the students. The candidate seeking opt-out shall be permitted to repeat old and new course in 2021 subject to conducive situations.
In its order, the SC bench said that the Opt-out scheme itself provides entitlement to opt-out and will not be treated as an attempt. That candidate will be permitted to appear in the next exam.
Further, the apex court ordered that candidate need not produce an RT-PCR report if the report produced by the medical practitioner is placed with the application for opting out. Tibrewal claims that State has failed to effectively provide support to the Committee and this is contempt of the Court’s order dated June 18.
“Candidates who have suffered personally or family members can be certified by medical practitioner, or for that he is disabled to appear for exam, he should be allowed to opt out and it should not be considered as an attempt,” the Supreme Court said in its order.

A PIL was filed by the activists for the safety of the students, RT-PCR test, alternate attempt before November, and extension of old-course. For RT-PCR, yesterday the Hon’ble Supreme Court had agreed that it was mandatory.
